Using your Cumberland Card within E-Wallets

Terms & Conditions

These conditions relate to any cards issued by Cumberland Building Society (‘us’) that you’ve added to an e-wallet on your device and are in addition to the Cumberland Card Terms and Conditions and Cumberland Savings and Current Account Terms and Conditions. They should be read in conjunction with our ‘How to Protect Yourself from Fraud’ leaflet.

If there’s any conflict between these conditions and the Cumberland Card Terms and Conditions and Cumberland Savings and Current Account Terms and Conditions, your card and account conditions will apply.

When you add your Cumberland card (‘card’) to an e-wallet you agree that you’ll use it subject to these conditions, your card conditions and your account conditions. You must only add a card in your name to an e-wallet on your device.

An e-wallet is a third party service and we are not responsible to you for your use of it or for any service, information, software or hardware provided to you by them including failures of that service, performance, and availability or security issues. You may also have agreements with other third parties in relation to your use of an e-wallet such as other current account providers or credit card issuers. We are not responsible for any agreements you enter into with these third parties.

Your e-wallet and/or device provider may have their own terms and conditions and privacy policies which you’re also subject to.

If we don’t hold your mobile number, you may need to call us as part of the registration process to add your card to an e-wallet. Our opening hours can be found here.

Meanings of words and expressions

Card any card that we supply to you to use with your account
device a mobile phone, tablet, smartwatch, desktop computer or other digital device
security details the personal identification number (PIN)/password and your fingerprint(s) that you use to access/unlock your device
e-wallet a system that securely stores card details to allow you to make electronic purchases via a device

Taking care of your device

You should keep your security details, along with your mobile device, safe in the same way you would with your physical debit card and other personal identification numbers and passwords.

You must take all reasonable steps to keep your security details confidential and your e-wallet and device safe at all times. In particular you must:

  • setup a PIN/password and/or fingerprint(s) on your device
  • set your device to lock after a period of inactivity
  • follow all security measures recommended by your e-wallet and device providers
  • not leave your device unlocked when unattended
  • not choose a PIN/password for your device that can be easily guessed by anyone else
  • not tell anyone the PIN/password for your device
  • not allow anyone else to use your e-wallet
  • not store anyone else’s fingerprint(s) on your device.

If you share your PIN/password for your device with anyone else or add anyone else’s fingerprint(s) to your device and transactions take place on your account that you didn’t authorise, you will be liable for all such transactions.

If you act without reasonable care or fraudulently, and this results in unauthorised transactions on your account, you might be responsible for them.

Call us on 01228 403 141 immediately if:

  • you lose your device;
  • your device is stolen;
  • your device is used without your consent;
  • your security details have been compromised; or
  • there are any transactions on your account that you don’t recognise.

If you think your security details have been compromised you must immediately change the PIN/password on your device and check that only your fingerprint(s) is linked to your device.

You must not add your card to an e-wallet on a jailbroken or rooted device (i.e. a device which has had its default operating system restrictions removed). If you do and transactions take place that you didn’t authorise, you will be liable for all such transactions.

It’s possible to setup a ‘second’ device to make e-wallet payments, by connecting your ‘second’ device(s) to the e-wallet you’ve already added your card to. Where a ‘second’ device(s) is linked to an e-wallet you’ve already added your card to, these conditions apply.

Suspending or discontinuing use

You can remove your cards from an e-wallet at any time by following your e-wallet providers’ instructions or by calling us on 01228 403 141. In these circumstances you authorise us to continue to process any outstanding transactions on your card(s).

You must remove your cards from all e-wallets on your device when you:

  • dispose of it e.g. by selling or giving it to someone else;
  • pass it to someone else temporarily e.g. for it to be repaired; or
  • close your account.

We might suspend or terminate the use of any cards you’ve added to an e-wallet if:

  • you breach these conditions, your account conditions and/or your card conditions;
  • you breach your e-wallet and/or device provider conditions; or
  • we suspect any fraudulent activity or misuse of your e-wallet, device, card and/or account.

We reserve the right to stop offering or supporting any e-wallet provider or service.

The e-wallet provider and/or device provider reserves the right to:

  • suspend or terminate the use of your card in their e-wallet/device;
  • change the functionality of their e-wallet without reference to us; and
  • withdraw their service at any time.

We wouldn’t be liable to you or any third party arising from this.

Your information

We’ll use your personal information in accordance with your card conditions.

We might get information about you from your e-wallet and/or device provider to verify your identity, check your eligibility and to prevent fraud.

We might collect and use information about your e-wallet and device, including transaction data, to help us improve our products and services, and for fraud prevention. We might use this data for testing purposes.

We might share non-personal information relating to your e-wallet transactions with your e-wallet and/or device provider. This statistical information shows how customers are using an e-wallet(s).

Service availability

We will not be liable to you for any breach of these conditions due to circumstances beyond our reasonable control. This may include times where you're unable to use your card within an e-wallet.

Changes to these conditions

We reserve the right to change these conditions at any time in accordance with your card conditions and account conditions. You’ll be able to view any amended conditions on our website here or via the e-wallet on your device.

If you don’t accept any changes you can remove your cards from your e-wallet at any time, by following your device providers’ instructions or by calling us on 01228 403 141. In these circumstances you authorise us to continue to process any outstanding transactions on your card(s).

Complaints

If you have a complaint please notify us in accordance with our complaints procedure.

Governing law and jurisdiction

These Conditions are governed by the laws of England and Wales as are our dealings with you. You and we submit to the non-exclusive jurisdiction of the courts of England & Wales.
